SoMate Terms of Service

Welcome to SoMate!

These Terms of Service("Agreement") are entered into by ECHOMIND PTE.LTD.(hereinafter referred to as"SoMate,""we,""our,"or"us") and you(hereinafter referred to as"User" or"you"). These terms govern your access to and use of the SoMate mobile application, web application, the somate.love website, and other related services(collectively referred to as the"Services").

These terms outline important legal rights and obligations. By accessing or using our Services, you agree to comply with this Agreement and our Privacy Policy. If you do not agree to these terms, please immediately stop accessing or using SoMate.

1. Account Registration and Usage

1.1 Account Registration

• Users can log in to SoMate using a Google or Apple account. Upon login, a SoMate account is automatically created. In some countries or regions, users may register using a mobile phone number, in which case we will collect your phone number and verification code for authentication purposes.

• Users must provide accurate, complete, and up-to-date information and are fully responsible for all activities associated with their account.

1.2 Account Security

• Users must keep their account information and password confidential and bear full responsibility for any activities occurring under their account.

• If you become aware of any unauthorized use of your account or other security breaches, you must notify SoMate immediately.

1.3 Account Deletion

• Users may delete their account at any time through the SoMate app or by contacting us via email.

• Upon deletion, all user data will be permanently removed unless required to be retained by law.

• Once an account is deleted, data cannot be recovered, and the account cannot be reactivated.

1.4 Protection of Minors

• If you are under 18 years old, you are not eligible to register for or use the Services.

2. SoMate Services

2.1 Service Content

SoMate provides Al-powered interactive services through text, voice, and other interfaces, including but not limited to:

• Al character interactions (text, voice, image, and video-based conversations)

• Personalized recommendations based on interactions

• Subscription plans and virtual goods purchases

• Other features (such as user rewards and point systems)

2.2 Service Modifications

• SoMate reserves the right to modify, suspend, or terminate any part of the Services at any time without prior notice.

• SoMate is not liable for any loss resulting from modifications or termination of Services.

2.3 Paid Services

• SoMate offers both free and paid subscription plans (such as SoMate Premium).

• Users may purchase virtual goods within the app.

• Paid subscriptions are subject to the payment policies of Apple, Google Play, or other payment platforms.

3. User Conduct

By using SoMate, you agree that you will NOT:

• Transmit, post, or store illegal, obscene, hateful, discriminatory, fraudulent, harassing, or otherwise inappropriate content;

• Infringe on the privacy, intellectual property, or other legal rights of others;

• Impersonate others or misuse Al characters for malicious activities;

• Spam, use automated scripts, or abuse the Services;

• Attempt to bypass SoMate's security mechanisms or engage in reverse engineering;

• Engage in any other activity deemed inappropriate by SoMate.

SoMate reserves the right to suspend or terminate accounts that violate these terms.

4. Al Character Interactions and Data Processing

4.1 Nature of AI Characters

• SoMate's Al characters are interactive artificial intelligence systems and not real humans. They do not provide medical, legal, financial, or psychological advice.

• Al-generated responses may be inaccurate, incomplete, or unexpected. Users should exercise their own judgment when interacting with Al characters.

4.2 User Data Management

• Users may delete chat history with Al characters at any time. Once deleted, the data cannot be restored.

• Users may report or flag Al characters within the app, and our team will review and take necessary actions.

5. Intellectual Property

5.1 SoMate Content

• All software, interfaces, text, images, videos, algorithms, and other content in SoMate are protected by intellectual property laws.

• Users may not copy, modify, distribute, sell, or commercially exploit any part of SoMate's content without prior authorization.

• The SoMate name, trademarks, and logo are owned by ECHOMIND PTE LTD. and may not be used without permission.

5.2 User-Generated Content (UGC)

• Users retain ownership of their text, images, voice recordings, and other content shared on SoMate.

• Users own the Al characters they create through SoMate's Al automation features.

• By submitting content to SoMate, users warrant that they own all necessary rights, licenses, and approvals to do so.

• Users grant SoMate a non-exclusive, worldwide, royalty-free, fully-paid, transferable, sublicensable, perpetual, and irrevocable license to use, display, distribute, modify, and commercialize their submitted content, including for AI learning improvements and service optimization.

6. Limitation of Liability

6.1 Service Disclaimer

• SoMate only provides Al character services and does not offer professional psychological, medical, legal, or financial advice.

• We do not guarantee the accuracy, consistency, or applicability of Al character responses. Users must independently evaluate the suitability of Al-generated responses.

6.2 Liability Limitations

• SoMate is not liable for direct, indirect, incidental, special, or punitive damages resulting from the use or inability to use the Services, including but not limited to data loss, account breaches, or financial losses.

• In all cases, SoMate's maximum liability shall not exceed the total amount paid by the user in the past six (6) months or $100 USD, whichever is higher.

7. Dispute Resolution

7.1 Governing Law

• This Agreement shall be governed by the laws of Singapore, excluding its conflict of law principles.

• Any disputes shall first be resolved amicably. If no resolution is reached, both parties agree to submit the dispute to the Singapore International Arbitration Centre (SIAC) for final arbitration.

7.2 Dispute Handling

• Users may contact SoMate at hello@somate.love for dispute resolution.

• Class action lawsuits are not permitted—all disputes must be resolved on an individual basis.

8. Termination and Modifications

8.1 Account Suspension or Termination

SoMate may suspend or terminate your account under the following conditions:

• Violation of this Agreement;

• Fraudulent use of SoMate services;

• Other activities that SoMate deems harmful to the platform or users.

8.2 Updates to This Agreement

• SoMate reserves the right to update this Agreement at any time. Updates will be posted on the SoMate app and website with an effective date.

• Continued use of the Services after an update constitutes acceptance of the revised terms.
